Terms and Conditions

1. �Refer a Friend� Campaign
1.1.   The EFFIMARK �Refer a Friend� Campaign (hereinafter
called the "Programme") offered by Effimark, Inc. (hereinafter called
"EFFIMARK") for customers in India wherein Reward Points earned by a
Member of the Program will be redeemable with Cash. (hereinafter
called "Rewards").
1.2.   The Program will be effective from 1st September 2009 and shall
Terminate on December 31st, 2009 or until EFFIMARK terminates the Program.
1.3.   Customers will automatically be enrolled in the rewards program
once they join (register) on the Online website www.terimerideal.com.
1.4.   The Program website will allow the Member and Registered user
to search and submit deals, check their Reward point balance and
update their particulars. Only Member will be able to view their point
balance


2. Eligibility and membership
2.1.   The Program is open to all Indian residents and Non-Resident
Indians, although
at all times eligibility for membership is at the sole discretion of EFFIMARK,
2.2.   In the event, the Member fails to comply with the Program
eligiblity criteria in the course of the membership period, its
Membership in the Program will be terminated and Member will be
notified for such termination. In such event, all accumulated Reward
Amount may be forfeited, at EFFIMARK's sole discretion.
2.3.   To participate in the Program, the applicants (hereinafter
called the "Registered User") will be automatically registered in the program when they sign up as member for terimerideal.com. There is no
joining fee and membership in the Program is granted at the sole
discretion of EFFIMARK whose decision on this shall be final and
binding on the parties.
2.4.   Member acknowledges that EFFIMARK may, at its sole discretion,
restrict, suspend, withdraw or otherwise alter aspects of or the whole
of the Program, with or without notice at any time to the Member or
Members (as the case may be), except as specifically provided herein.
2.5.   If in EFFIMARK's sole opinion, a Member abuses any of the Program
privileges, fails to comply with any of the terms and conditions
herein or makes any misrepresentation to EFFIMARK, EFFIMARK reserves
the right to terminate the Member's participation in the Program or
revoke all the Reward Point that have been earned by the Member.
EFFIMARK's determination on the matters raised in this paragraph 2.8
shall be final and conclusive.
2.6.   Member must keep a current address including email and phone to
ensure that all Program communications are being sent to the proper
address. A Member must immediately change the information online when
required.


3. Membership Type
3.1.   The Program classifies all registered Contacts as Members, who
can enjoy membership privileges as described in clause 4 below.


4. Earning Reward Points and Cash Award
4.1.   When joining the website (www.terimerideal.com), the member
(originating member)  will receive 500 points as one time basis.
4.1. When the joined members refers the website to other members, he
or she will earn additional XXX points per referral.
4.2. When any of the referred members join the website
(www.terimerideal.com), the originating member will get additional XXX
points.
4.3. When the members joining in 4.2. refer other members via email,
the �originating member� will get additional points
4.4.   The top 5 members in aggregate points per month, with a minimum
point balance of 1500, will receive a cash award of Rs 2,500.00
4.5.   Top 2 members with aggregate points over the period of
promotion (Sep 1st 2009 to December 31st 2009), with minimum points of
5000, will receive additional award of Rs 10,000.
4.5. To receive the cash reward, members have to have an account with
either �paypal� or �XX�
4.6.   For each referred member and joining member, the phone number
and email address provided must be valid, otherwise, EFFIMARK reserves
the right to decline the points award.
4.7.   EFFIMARK reserves the right to withhold Reward amount earned
from Referral program.
4.8.   EFFIMARK reserves the right to change the basis on which Reward
amounts are awarded (including number of Amount rewarded) at any time,
with or without notice, at EFFIMARK's sole discretion.
4.9.   Members will be able to view their monthly statements online
showing the Reward Points they have accumulated via the Program
website. EFFIMARK reserves the right to delay or postpone the issuance
of statement. In the absence of obvious error, the number of Reward
Amounts stated in the Program website will be binding and conclusive.


5. Point deduction and validity
5.1.   Any Reward Amount suspected to be fraudulently recorded or
earned by Member.
  5.1.1.   Any Point Amount recorded in error; and
   5..1.2.   Any Point Amount relating to a referral email that does
not go through


6. General
6.1.   Information provided by Members/Registered User gathered at the
point of Program enrollment will be used by EFFIMARK for administering
the Program, marketing planning, research and other related marketing
Program purposes
6.2.   The information may also be used to communicate news and
promotions to the Member by EFFIMARK. Member has the right to decline
to receive such communication by contacting the Program Centre at any
time.
6.3.   EFFIMARK reserves the right to cancel or revise or suspend the
Program or the terms and conditions herein at any time it deems
necessary with or without notice and without having to give any
reasons for doing so. EFFIMARK may (but shall not be obliged to) give
advance notice to Members in the manner it deems appropriate in the
event it decides to cancel, revise or suspend the Program or the terms
and conditions stated herein..
6.4.   Program terms and conditions in the Program website shall be
most updated and final.
6.5.   EFFIMARK's failure to enforce a particular term and condition
does not constitute a waiver of that term and condition by EFFIMARK
6.6.   EFFIMARK assumes no responsibility for any claims, losses,
costs, expenses or damages of whatever nature resulting from the
joining of the program
6.7.   Suspected or actual fraud and/or suspected or actual abuse
relating to the accumulation of Reward Points or redemption of Rewards
may result in immediate forfeiture of accumulated Reward Amount as
well as termination of Member's participation in the Program in
addition to any other rights or remedies may have whether in law or
equity.
6.8   All questions or disputes regarding eligibility for the Program
or the Reward Amount accrual or redemption of Rewards will be
determined by EFFIMARK at its sole discretion.
6.9.   Reward Points are not transferable to another Member.
6.10   EFFIMARK's decision on all matters pertaining to the Program is final.
